A successful placement of an informal care home stands or falls with good preparation. It is essential to first know the local rules and have the necessary documentation complete before you submit an official application. The entire process roughly consists of the phases: Preparation, Procedure, and Placement.

### Consultation with the municipality
|
||||
Always contact **your** municipality at an early stage. Inquire whether building on **your** plot can take place without a permit and which **specific requirements** the municipality sets for the documentation and the care indication. This prevents delays or even rejections.

### Collecting care indication and documentation
|
||||
Ensure that you have the necessary evidence, such as the **medical statement or CIZ indication**, in your possession in a timely manner. In addition, collect the technical construction documents, such as detailed **construction drawings**, a **site plan** (indicating the exact position on the plot), and, if necessary, a **structural calculation** to guarantee safety.

## The official procedure
|
||||
|

Depending on the outcome of the preliminary investigation, one of two procedures follows: the notification (permit-free) or the application (permit-required).

### Permit-free notification
|
||||
If your plans meet the national and local rules for permit-free construction, a **notification** to the municipality is often sufficient. The municipality confirms the placement and does not need to grant a formal permit.
|
||||

### Permit-required application
|
||||
If you deviate from the rules (for example, by placement in the front yard or due to the size), you must submit an **environmental permit application** via the Omgevingsloket. The municipality then has a statutory period to process the application. This procedure can take **several weeks to months**.

## Placement and termination
|
||||
|
||||
After approval or following the notification procedure, construction or placement can begin. Remember that the informal care home always has a temporary status.
|
||||

### Actual placement and use
|
||||
The home may only be placed after the municipality has agreed. During construction, strictly adhere to the technical construction requirements from the Building Decree (Bouwbesluit), even if no permit was required.
|
||||
|
||||
### Termination of informal care
|
||||
When the care stops, you must **inform the municipality in writing**. The residential function of the informal care home must then be terminated and the home must, depending on the situation, be removed or repurposed.
|
||||
|
||||

In many cases, you may place an informal care home **permit-free** under certain conditions. This is regulated in the Living Environment Buildings Decree (Besluit bouwwerken leefomgeving - Bbl) and local zoning plans. The status depends on the location and dimensions of the structure on your plot.

## Permit-free construction
|
||||
|
||||
The permit-free placement of an informal care home is intended to speed up the process in case of acute care needs. You are usually allowed to place the home permit-free if the following basic conditions are met:
|
||||
|
||||
* The home is located in the **back garden** or on the rear yard area (the part of the plot that lies behind the main house and does not border the public road).
|
||||
* The home complies with the construction rules for **associated buildings**, such as the maximum permitted dimensions in relation to the size of your plot [^1].
|
||||
* The need for informal care is **demonstrable** (via an official medical statement or CIZ indication) [^2]. Without this demonstrable care relationship, permit-free construction is not possible.

||||
* **Placement in the Front Yard:** The home is placed in the **front section** of the plot (front yard). This is the area between the front facade of the main building and the public road.
|
||||
* **Exceeding Dimensions:** The home is **larger** than the maximum permitted dimensions for permit-free outbuildings, as determined by national rules and/or your local zoning plan.
|
||||

#### Zoning plan and location
|
||||
|
||||
* **Inconsistency with zoning plan:** The local **zoning plan** imposes strict restrictions that prevent construction. In that case, you must go through a deviation procedure (environmental permit).
|
||||
* **Protected village or cityscape:** If the plot is located in an area designated as a protected village or cityscape (usually due to historical value), stricter rules apply to the appearance and integration of the home.
|
||||
* **Nature and environmental areas:** When placing in or near **Natura 2000 areas** or other nature or environmental protection zones, a permit may be required due to the Nature Conservation Act, or the permit may even be refused.

* **Planned changes:** If the municipality is working on a **change to the zoning plan** that has direct consequences for your plot, the application may be suspended or assessed against future rules.
